Background and aim Healthcare professionals are regularly exposed to moral challenges in patient care potentially compromising quality of care and safety of patients. Preventive clinical ethics support aims to identify and address moral problems in patient care at an early stage of their development. This study investigates the occurrence, risk factors, early indicators, decision parameters, consequences and preventive measures of moral problems. Method Semi-structured expert interviews were conducted with 20 interprofessional healthcare professionals from 2 university hospitals in Basel, Switzerland. A (...) Likert scale questionnaire was completed by the interviewees and analysed using descriptive and inferential statistics. Results Healthcare professionals are frequently exposed to a variety of moral problems, such as end-of-life decisions, resource allocation and assessing the patient's will or decisional capacity. Thirty-four different risk factors for moral problems are identified, e.g. patient vulnerability, divergent values or world views, inadequate resources or poor ethical climate. Twenty-one early indicators are recognised such as disagreement between healthcare professionals, patients and relatives, emotional disturbances, gut feeling or conflict of conscience. A variety of preventive measures are suggested and presented in a preventive clinical ethics support process model. The most helpful measures are early ethical conversations with colleagues, early team-internal ethical case discussions and an ethics-trained contact person on the ward. Ethics training, kerbside consultations, proactive ethics consultations, ethics screening and rounds are also considered helpful. Conclusions Clinical ethics support services should not only offer reactive and complex, but also proactive and low-threshold support for healthcare professionals, patients and relatives. (shrink)

This paper introduces the motivation and idea behind the recently founded interdisciplinary initiative Critical Neuroscience ( http://www.critical-neuroscience.org ). Critical Neuroscience is an approach that strives to understand, explain, contextualize, and, where called for, critique developments in and around the social, affective, and cognitive neurosciences with the aim to create the competencies needed to responsibly deal with new challenges and concerns emerging in relation to the brain sciences. It addresses scholars in the humanities as well as, importantly, neuroscientific practitioners, policy makers, (...) and the public at large. Does neuroscience indeed have such wide-ranging effects or are we collectively overestimating its impacts at the expense of other important drivers of social and cultural change? Via what channels is neuroscience interacting with contemporary conceptions of selfhood, identity, and well-being? Importantly, Critical Neuroscience strives to make the results of these assessments relevant to scientific practice itself. It aspires to motivate neuroscientists to be involved in the analysis of contextual factors, historical trajectories, conceptual difficulties, and potential consequences in connection to their empirical work. This paper begins to spell out a philosophical foundation for the project by outlining examples of the interaction taking place between the neurosciences and the social and cultural contexts in which they are embedded and by exposing some of the assumptions and argumentative patterns underlying dominant approaches. Recent anthropological work will be discussed to convey a sense of the de facto interactions between neuroscientific knowledge, its promissory projections, and the self-understandings of laypeople. This can be seen as a first step towards a phenomenology of the “seductive allure” that the neurosciences are exerting upon both the academic and the popular imagination. The paradox of material implication has remained unresolved since antiquity because it was believed that the nature of implication was entailment. The article shows that this nature is opposition and therefore the name "implication" should be replaced with the name "competition". A solution to the paradox is provided along with appropriate changes in nomenclature, the addition of connectives and the postulate that the biconditional take over the role of the previous implication. Paradoks implikacji materialnej pozostawał nierozwiązany od starożytności, ponieważ uważano, że naturą implikacji jest wynikanie. Artykuł ukazuje, że tą naturą jest przeciwstawność. Zostaje podane rozwiązanie paradoksu wraz z odpowiednimi zmianami nazewnictwa, dodaniem konektywów i postulatem przejęcia roli dotychczasowej implikacji przez równoważność. Ponadto zaproponowane zostają zmiany nazewnictwa bramek logicznych, odwzorowujących kompetycję w elektronice.

The dilemma mentioned in the title have long been a puzzle to logic. To solve it, it was necessary to make some philosophical decisions. The article provides these decisions and discusses the way to solve the problem.

This paper sketches an approach to pronoun reference resolution in context based on a dynamic incremental semantics for NL in polymorphic type theory. Does the real world, defined as a world of objects that exist independent of human interests, concerns, and cognitive activities, really exist? Jan Westerhoff argues that we have good reason to believe it does not. His discussion considers four main facets of the idea of the real world, ranging from the existence of a separate external and internal world, to the existence of an ontological foundation that grounds the existence of all the entities in the world, and the existence of (...) an ultimately true theory that provides a final account of all there is. As Westerhoff discusses the reasons for rejecting the postulation of an external world behind our representations, he asserts that the internal world is not as epistemically transparent as is usually assumed, and that there are good reasons for adopting an anti-foundational account of ontological dependence. Drawing on conclusions from the ancient Indian philosophical system of Madhyamaka Buddhism, Westerhoff defends his stance in a purely Western philosophical framework, and affirms that ontology, and philosophy more generally, need not be conceived as providing an ultimately true theory of the world. Jan Westerhoff unfolds the story of one of the richest episodes in the history of Indian thought, the development of Buddhist philosophy during the first millennium CE. He aims to offer the reader a systematic grasp of key Buddhist concepts such as non-self, suffering, reincarnation, karma, and nirvana.

This paper elaborates a new solution to the lottery paradox, according to which the paradox arises only when we lump together two distinct states of being confident that p under one general label of ‘belief that p’. The two-state conjecture is defended on the basis of some recent work on gradable adjectives. The conjecture is supported by independent considerations from the impossibility of constructing the lottery paradox both for risk-tolerating states such as being afraid, hoping or hypothesizing, and for risk-averse, (...) certainty-like states. The new proposal is compared to views within the increasingly popular debate opposing dualists to reductionists with respect to the relation between belief and degrees of belief. (shrink)

The Indian philosopher Acarya Nagarjuna (c. 150-250 CE) was the founder of the Madhyamaka (Middle Path) school of Mahayana Buddhism and arguably the most influential Buddhist thinker after Buddha himself. Indeed, in the Tibetan and East Asian traditions, Nagarjuna is often referred to as the "second Buddha." This book presents a survey of the whole of Nagarjuna's philosophy based on his key philosophical writings. His primary contribution to Buddhist thought lies in the further development of the concept of sunyata or (...) "emptiness." For Nagarjuna, all phenomena are without any svabhava, literally "own-nature" or "self-nature," and thus without any underlying substance. Particular emphasis is put on discussing Nagarjuna's thinking as philosophy. The present discussion shows how his thoughts on metaphysics, epistemology, the self, language, and truth present a unified theory of reality with considerable systematic appeal. The book offers a systematic account of Nagarjuna's philosophical position. It reads Nagarjuna in his own philosophical context, but also shows that the issues of Indian and Tibetan Buddhist philosophy have at least family resemblances to issues in European philosophy. It is commonly accepted – not only in the philosophical literature but also in daily life – that ignorance is a failure of some sort. As a result, a desideratum of any ontological account of ignorance is that it must be able to explain why there is something wrong with being ignorant of a true proposition. This article shows two things. First, two influential accounts of ignorance – the Knowledge Account and the True Belief Account – do not satisfy this (...) requirement. They fail to provide a satisfying normative account of the badness of ignorance. Second, this article suggests an alternative explanation of what makes ignorance a bad cognitive state. In a nutshell, ignorance is bad because it is the manifestation of a vice, namely, of what Cassam calls “epistemic insouciance”. (shrink)

Nagarjuna's Vigrahavyavartani is one of the most important Madhyamaka Buddhist philosophical texts. Jan Westerhoff offers a new translation, reflecting the best current philological research and all available editions, and adds his own philosophical commentary on the text. His nuanced, philosophically sophisticated commentary explains Nagarjuna's arguments in a way that is both grounded in historical and textual scholarship and connected explicitly to contemporary philosophical concerns.

Although collegial relationships are among the most prevalent types of interpersonal relationships in our lives, they have not been the subject of much philosophical study. In this paper, we take the first step in the process of developing an ethics of collegiality by establishing what qualifies two people as colleagues and then by determining what it is that gives value to collegial relationships. We argue that A and B are colleagues if both exhibit sameness regarding at least two of the (...) following three features: the same work content or domain of activity; the same institutional affiliation or common purpose; and/or the same status or level of responsibility. Moreover, we describe how the potential value of collegial relationships is grounded in the relationship goods that two colleagues have reason to generate qua colleagues, namely, collegial solidarity and collegial recognition. Two interesting conclusions that can be drawn from our analysis are that one has to be proficient at one’s work if one is to be considered a good colleague and that we are also more likely to be better colleagues if we regard the work we do as valuable. Finally, we draw special attention to the working conditions that are conducive to the generation of good collegial relationships and suggest some policies to promote them. (shrink)

Strategic ignorance is a widespread phenomenon. In a laboratory setting, many participants avoid learning information about the consequences of their behaviour in order to act egoistically. In real life, many consumers avoid information about their purchases or the working conditions in which they were produced in order to retain their lifestyle. The question is whether agents are blameworthy for such strategically ignorant behaviour. In this paper, I explore quality of will resources, according to which agents are blameworthy, roughly, depending on (...) their moral concern. The account I will propose—the Maximal Account—has three innovative features: it utilizes a suitable concept of maximal moral concern, it offers an accountability version of the account which significantly differs from the more familiar attributability variant, and it maintains that agents without maximal concern are blameworthy. According to Vallicella's 'Relations, Monism, and the Vindication of Bradley's Regress' (2002), if relations are to relate their relata, some special operator must do the relating. No other options will do. In this paper we reject Vallicella's conclusion by considering an important option that becomes visible only if we hold onto a precise distinction between the following three feature-pairs of relations: internality/externality, universality/particularity, relata-specificity/relata-unspecificity. The conclusion we reach is that if external relations are to relate their relata, they must be (...) relata-specific (and no special operator is needed). As it eschews unmereological complexes, this outcome is of relevance to defenders of the extensionality of composition. (shrink)

Why act when the effects of one’s act are negligible? For example, why boycott sweatshop or animal products if doing so makes no difference for the better? According to recent proposals, one may still have a reason to boycott in order to avoid complicity or participation in harm. Julia Nefsky has argued that accounts of this kind suffer from the so-called “superfluity problem,” basically the question of why agents can be said to participate in harm if they make no difference (...) to it. There is unanimous agreement that Nāgārjuna (ca 150–250 AD) is the most important Buddhist philosopher after the historical Buddha himself and one of the most original and influential thinkers in the history of Indian philosophy. His philosophy of the “middle way” (madhyamaka) based around the central notion of “emptiness” (śūnyatā) influenced the Indian philosophical debate for a thousand years after his death; with the spread of Buddhism to Tibet, China, Japan and other Asian countries the writings of Nāgārjuna became an (...) indispensable point of reference for their own philosophical inquiries. A specific reading of Nāgārjuna's thought, called Prāsaṅgika-Madhyamaka, became the official philosophical position of Tibetan Buddhism which regards it as the pinnacle of philosophical sophistication up to the present day. This article offers a functionalist account of trust. It argues that a particular form of trust—Communicated Interpersonal Trust—is paradigmatic and lays out how trust as a social practice in this form helps to satisfy fundamental practical, deliberative, and relational human needs in mutually reinforcing ways. We then argue that derivative (non-paradigmatic) forms of trust connect to the paradigm by generating a positive dynamic between trustor and trustee that is geared towards the realization of these functions. We call this trust’s proleptic (...) potential. Our functionalist approach does not only provide important insights into the practice of trust and its place in the broader web of social life, but also illuminates existing philosophical debates. First, pointing out how opposing theoretical accounts of trust each capitalise on only one of its functions, our paradigm-based approach reveals why they each contain a kernel of truth but are also deficient: the optimal realization of each function is tied to the existence of the other functions as well. Second, we show how a functionalist re-orientation can illuminate two recent disputes regarding (i) the question whether trust is explanatorily two- or three-place and (ii) whether (and to what extent) we can decide to trust others. And very occasionally it will be real libertarians explaining and defending their views. J C Lester is a libertarian philosopher who has been writing about why liberty is preferable to politics for many years. This book contains many of his shorter writings on the subject. These range from the populist to the philosophical. Together they function as a miscellaneous introduction to libertarianism. New computer systems of discovery create a research program for logic and philosophy of science. These systems consist of inference rules and control knowledge that guide the discovery process. Their paths of discovery are influenced by the available data and the discovery steps coincide with the justification of results. The discovery process can be described in terms of fundamental concepts of artificial intelligence such as heuristic search, and can also be interpreted in terms of logic. The traditional distinction that places (...) studies of scientific discovery outside the philosophy of science, in psychology, sociology, or history, is no longer valid in view of the existence of computer systems of discovery. It becomes both reasonable and attractive to study the schemes of discovery in the same way as the criteria of justification were studied: empirically as facts, and logically as norms. (shrink)

BackgroundSexual boundary violations in healthcare are harmful and exploitative sexual transgressions in the professional–client relationship. Persons with mental health issues or intellectual disabilities, especially those living in residential settings, are especially vulnerable to SBV because they often receive long-term intimate care. Promoting good sexual health and preventing SBV in these care contexts is a moral and practical challenge for healthcare organizations.MethodsWe carried out a qualitative interview study with 16 Dutch policy advisors, regulators, healthcare professionals and other relevant experts to explore (...) their perspectives on preventing SBV in mental health and disability care organizations. We used inductive thematic analysis to interpret our data.ResultsWe found three main themes on how healthcare organizations can prevent SBV in mental health and disability care: setting rules and regulations, engaging in dialogue about sexuality, and addressing systemic and organizational dimensions.ConclusionOur findings suggest that preventing SBV in mental health and disability care organizations necessitates setting suitable rules and regulations and facilitating dialogue about positive aspects of sexuality and intimacy, as well as about boundaries, and inappropriate behaviors or feelings. Combining both further requires organizational policies and practices that promote transparency and reflection, and focus on creating a safe environment. Our findings will help prevent SBV and promote sexual health in mental health and disability care organizations. (shrink)

This introduction provides an overview of the current state of the debate on the epistemic condition of moral responsibility. In sect. 1, we discuss the main concepts ‘ignorance’ and ‘responsibility’. In sect. 2, we ask why agents should inform themselves. In sect. 3, we describe what we take to be the core agreement among main participants in the debate. In sect. 4, we explain how this agreement invites a regress argument with a revisionist implication. In sect. 5, we provide an (...) overview of the main responses to the regress argument. In sect. 6, we address the question why blameless ignorance excuses. In sect. 7, we describe further issues that are addressed in the book. This paper presents scientists’ understanding of their roles in society and corresponding responsibilities. It discusses the researchers’ perspective against the background of the contemporary literature on scientific responsibility in the social sciences and philosophy and proposes a heuristic that improves the understanding of the complexity of scientific responsibility. The study is based on qualitative interviews with senior scientists. The presented results show what researchers themselves see as their responsibilities, how they assume them, and what challenges they perceive with respect to (...) their responsibilities. Regarding the latter, the interviewed researchers highlight those aspects of responsibility that go beyond the expertise of their professional role, and thus cannot be carried by scientists alone. For example, scientists alone cannot determine the general direction science takes, or the useful application of their research. The interviewed researchers describe those challenges as responsibilities that must be shared across different societal groups. In the theoretical literature, responsibility has been described as a relation between an actor (who), the action for which someone is responsible (what), and the normative framework against which someone is responsible (why). We will draw on this concept of “relational responsibility” to identify the various actors, normative frameworks, and actions relevant to scientific responsibility. This will serve as a heuristic tool to help identify the entanglement of responsibilities spread across several societal groups. (shrink)

They draw heavily on the author's texts Lyric Philosophy, Wisdom & Metaphor, and “Bringhurst's Presocratics: Lyric and Ecology”. The present essay outlines key concepts — clarity as resonance, metaphor as gestalt shift, meaning as gesture, the overlap between philosophy and poetry, the nature of lyric truth — and suggests that they are essential to an adequate epistemology. These concepts allow us to address serious gaps in (...) our understanding of how humans think, gaps that have arisen owing to the limitations of linguified intelligence coupled with a disinclination to admit the existence of these limitations. The overview also describes fundamental differences between lyric philosophy and analytic philosophy, while insisting on a robust conception of truth and on the existence of a knowable mind-independent world. The importance of a lyric approach for our understanding of a range of ecological questions is discussed, and lyric philosophy is positioned, politically, as a critique of technocracy. (shrink)

Political theorists tend to dismiss the concept of constitutional patriotism for two main reasons. On the one hand, constitutional patriotism — understood as a post-national, universalist form of democratic political allegiance — is rejected on account of its abstract quality. On the otherhand, it is argued that constitutional patriotism, while apprearing universalist, is in fact particular through and through. According to this genealogical critique, it is held that constitutional patriotism might have been appropriate in the context when it originated — (...) namely West Germany, a half-nation with a deeply compromised sense of nationality on account of the Nazi past — but it is not universally applicable. This article reconstructs the origins of constitutional patriotism arguing that both the ‘protective’ and state-centred patriotism of Dolf Sternberger, and the ‘purifying’ patriotism of Jurgen Habermas — focused mainly on the public sphere — can indeed be understood as relying on ‘supplements of particularily’. However, there are also normative connections between universalist constitutional morality and militant democracy on the one hand, and universalist constitutionalist morality and an imperative to remember on the other. We generalize a well-known theorem binding the elementary equivalence relation on the level of PAC fields and the isomorphism type of their absolute Galois groups. Our results concern two cases: saturated PAC structures and nonsaturated PAC structures.

A platitude questioned by many Buddhist thinkers in India and Tibet is the existence of the world. We might be tempted to insert some modifier here, such as “substantial,” “self-existent,” or “intrinsically existent,” for, one might argue, these thinkers did not want to question the existence of the world tout court but only that of a substantial, self-existent, or otherwise suitably qualified world. But perhaps these modifiers are not as important as is generally thought, for the understanding of the world (...) questioned is very much the understanding of the world everybody has. It is the understanding that there is a world out there —independent of our minds — and that when we speak and think about this world we mostly get it right. But the Madhyamaka thinkers under discussion here deny that there is a world out there and claim that our opinions about it are to the greatest part fundamentally and dangerously wrong. (shrink)

Summary This article examines the complex nature of post-war Italian political thought, stressing the importance of Italy's unusual institutional and historical political arrangements, but also the vibrancy of its political ideologies in this period. In the past it has often been argued that the dysfunctional nature of post-war Italian democracy with its rapidly changing governments, and widespread corruption—which nonetheless coexisted with the one party, the Christian Democrats, being constantly in power—led to the atrophying of political theory in general, and political (...) ideologies in particular. But this picture is strongly disputed here—on the contrary it is argued that Christian Democratic, Left and liberal political ideologies were all complex and interesting. Thus if Christian democracy should ultimately be seen as an ‘ideology of transition’ which existed to help Catholicism adapt to the parameters of modern mass democracy, and which lacked a thinker of the calibre of Jacques Maritain, it nevertheless contained within it important debates on the role of the state, between such interesting thinkers as Giuseppe Dossetti and Alcide De Gasperi. And if anything, political thinking on the Left in the post-war period was even more complex, with visceral debates within the (large) Communist Party (PCI) over whether to work within the law—between such thinkers as Palmiro Togliatti and the Il Manifesto group. Equally on the more revolutionary Left, there were important debates about how quickly capitalism could be made to collapse through revolutionary action between thinkers such as Raniero Panzieri and his more radical disciples, Mario Tronti and Antonio Negri, while later, due to the general failure of these revolutionary efforts, post-modern thinkers such as Gianni Vattimo sought to abandon grand metaphysical narratives, whilst retaining a commitment to Left of centre political commitments. Finally, although not part of a widespread mass movement, the liberal thought of Norberto Bobbio was also highly interesting and sophisticated—borrowing from Hobbes and Kelsen, he sought to advocate a modest form of liberal democracy which allowed for civilised forms of conflict, and the protection of minorities, and which rejected the contention of Marxists that civil rights could not be distinguished from economic ones. Overall, if normative aspirations in post-war Italian politics were often frustrated in practice, this was certainly not due to any lack of theoretical vibrancy. (shrink)
